Request regarding staff working whilst sick.

Published: 21 October 2021

Information requested

if NHS Counter Fraud was aware of any incidences where staff had claimed to be off sick and received sick pay for it while simultaneously working as bank staff? I ask because it came up in a Parliamentary written question the other day: https://questions-statements.parliament.uk/written-questions/detail/2021-10-15/56885. The data is required from March 2020 onwards.

NHSCFA response

  1. I can confirm that NHS Counter Fraud Authority holds information relating to incidences of staff working whilst off sick. However, we are unable to identify separate incidences where staff specifically undertake work as bank staff.
  2. To identify this information would involve a manual search of records and to search each log and retrieve the information would exceed the appropriate limit of £450.
  3. The appropriate limit has been specified in The Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 and for non-central Government departments it is set at £450. This represents the estimated cost of one person spending 18 hours in determining whether the Authority holds the information, and locating, retrieving and extracting the information.
  4. Under section 12 of the Freedom of Information Act the Authority is not obliged to comply with your request.
